A bench headed by NGT Chairperson Justice Swatanter Kumar imposed the fine of Rs. 10 lakh each on Gajraula-based ASP Sealing Products Ltd, Dairy India Private Ltd and Umang Dairies Ltd for not setting up effluent treatment plants in their premises and releasing untreated waste in the open and also for extracting ground water without permission from the Central Ground Water Authority (CGWA). More interestingly, the tribunal also issued notice to the UP Pollution Control Board (UPPCB) to Show Cause on why costs should not be imposed on them and action not taken against their erring officials for granting consent to such industries which have been causing pollution over these years. This action is expected to bring seriousness amongst those government officials who have not been diligently performing their duties.
A chance to all existing, new and expansion Industries/projects extracting ground water to obtain permission from Central Ground Water Authority
In compliance with National Green Tribunal (NGT), New Delhi judgment dated 11.01.2016* CGWA has issued a public notice to give a chance to all existing, new and expansion Industries/projects extracting ground water to obtain permission from Central Ground Water Authority subject to law in force. All the industrial units/ Infrastructure/Mining projects whether existing or new or under expansion, using ground water are directed to submit their applications online. Non-compliance of NGT directions may warrant closure of industries, operation or process or stoppage of supply of electricity or water or any other source, in addition to imposition costs by NGT for violation of directions. The CGWA has issued public notices dated 14.11.2015 and dated 29.04.2016. in this connection but several industries/projects using ground water have not complied with the directions of NGT. The Industries/Projects are hereby given last opportunity to submit their applications for NOC latest by 31.05.2017, failing which the penal provisions under section 15 of the Environment (Protection) Act, 1986 can be invoked against industries/projects violating the directions.*(for detailed directions please refer to websitehttp://cgwa-noc.gov.in or http://cgwb.gov.in or. website of Hon,ble NGT)
